1. Acceptance of Terms
By accessing or using Baba Bloom's baby registry platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
Baba Bloom provides a baby registry platform that allows expecting parents to create wishlists from products offered by third-party merchants. We facilitate the connection between registrants and merchants but do not sell products directly, process payments, or handle delivery.
3. User Accounts
To create a registry, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us of any unauthorised use of your account
4. Registry Use
When creating and using a registry, you agree to:
- Use the Service only for its intended purpose
- Not create registries for fraudulent purposes
- Not impersonate others or provide false information
- Not use the Service for any unlawful purpose
5. Purchases and Payments
All purchases are made directly with third-party merchants through their websites. Baba Bloom is not a party to these transactions and is not responsible for:
- Product quality, safety, or legality
- Merchant fulfilment or delivery
- Payment processing or security
- Returns, refunds, or exchanges
Any issues with purchases should be directed to the relevant merchant.
6. Merchant Terms
Merchants who partner with Baba Bloom agree to pay a 5% referral fee on attributed orders. Detailed merchant terms are provided separately in our Merchant Agreement.
7. Intellectual Property
The Baba Bloom name, logo, and all related content, features, and functionality are owned by Baba Bloom and are protected by intellectual property laws. You may not use our trademarks without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Baba Bloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the past twelve months (which, for parents and gift givers, is zero).
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Termination
We may terminate or suspend your account at any time for violations of these Terms. You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
